Self-Service Locker Use Agreement

This self-service locker use agreement (hereinafter referred to as the “Agreement”) shall specify the terms of use of self-service lockers by guests of our hotel before and after checking into the hotel to temporarily store baggage or belongings (hereinafter referred to as the “Baggage, etc.”) in a self-service locker for hotel guests (locker or wire types) (hereinafter referred to as the “Self-service Locker”). Hotel guests who use the Self-service Locker (hereinafter referred to as the “Users”) shall use the Self-service Locker after consent to this Agreement. The Self-service Locker shall be made available as a space for the Users to store Baggage, etc. temporarily. The hotel shall not take charge of Users’ Baggage, etc., and the hotel shall only be liable for the item(s) specified by this Agreement.

Article 1 (Purpose and Period of Use of the Self-service Locker)

Users may use the Self-service Locker from the time before check-in and after check-out until 24:00 on the day of checkout.

Article 2 (Limitations to the Items Stored)

  1. No item in any of the following categories shall be stored in the Self-service Locker:

(1) Cash and securities;
(2) Valuables (credit cards, cash cards and other items equivalent to cash, passports and other items used as User’s ID, jewelry, precious metals, paintings and writings, antiques, cameras, computers, and other expensive items, items containing personal information, expensive items exceeding 30,000 yen, items, documents, and material that other users think valuable);
(3) Animals, plants, and other living organisms, human or animal remains;
(4) Items requiring refrigeration of freezing;
(5) Volatile or toxic items, or explosives and other hazardous items;
(6) Firearms and swords, narcotics and simulants, or other items that may be related to criminal acts, or items whose possession is prohibited by law;
(7) Stolen items and other items acquired as a result of criminal acts;
(8) Items producing a foul or bad smell, unhygienic items, items that spoil easily, are easily damaged, or whose properties change quickly, items that may prevent the use of the self-service lockers due to contamination, damage, or hygienic reasons; and
(9) Heavy and large items (weighing more than 15 kg), or items that the hotel considers unsuitable for storage in the self-service lockers.

  1. In the case that the Baggage, etc. that the User stores in a self-service locker (hereinafter referred to as the “Stored Item(s)”) falls into the category of the items that cannot be stored as specified by the previous paragraph, or the hotel deems that the Stored Item(s) may fall into said category, the hotel may unlock the self-service locker even within the range of the period use, and may open the Stored Item(s), store separately, dispose of, report and transfer the Stored Item(s) to the police, and the User shall not object to the measures taken by the hotel. In addition, in the case that the hotel pays the cost to dispose of, etc. the Stored Item(s), the hotel may ask the User to bear the cost. The hotel shall not be liable for any damage to the User caused by the measures chosen by the hotel.

Article 3 (Handling of Password and Lost Key)

  1. Users shall exercise care in preventing a third person from obtaining the password for the self-service locker (wire type), and retain a memo containing the password on his/her own responsibility. The hotel shall not hold or accept responsibility for the relevant memo. In the case that a third party illegally unlocks the locker or steals anything due to the loss of the relevant memo, the hotel shall not be liable therefor.
  2. In the case that the User reports that the password for the self-service locker (wire type) has been lost of forgotten, or the User cannot unlock the self-service locker (locker type) due to use of an incorrect password, the hotel may unlock the relevant self-service locker if and only if the hotel can reasonably establish that the User is the User of the relevant self-service locker. In such cases, when the hotel hands over the Stored Item(s) to the relevant User, the hotel shall ask the relevant User to present identification and provide his/her name, address, and telephone number. The hotel may make a copy of the ID. Only when the hotel has reasonably determined that the Stored Item(s) belongs to the relevant User may the relevant User take possession of the Stored Item(s). If the relevant self-service locker (wire type) must be cut open, or if the User has lost the key for the self-service locker (locker type), the hotel shall ask the User to pay the cost of repair. If it is found that the Stored Item(s) does/do not belong to the User after the locker was opened in accordance with the provisions in this paragraph, and the Stored Item(s) was/were handed over to the User, the hotel shall not be liable therefor.

Article 4 (Measures Taken After the Period of Use)

  1. In the case that the Stored Item(s) is/are not removed after the period of use specified by Article 1 above, the hotel shall open the self-service locker, remove the Stored Item(s), and retain same as left behind at a predetermined location for a maximum of one week. In such case, the hotel may check the content of the item(s) left behind. The User must pay the fee for storage of the item(s) left behind, calculated by multiplying the number of days the item(s) is/are stored at the rate of 500 yen per day. However, in the case that the item(s) left behind include food or beverages, or it is determined to be impractical to store said item(s) due to hygiene reasons, the hotel shall dispose of the item(s) immediately even within the range of the maximum storage period.
  2. In the case of discovering item(s) left behind after the period of use and identifying the User, the hotel shall contact the relevant User as necessary. However, if the User does not respond to the contact from the hotel or if the hotel cannot identify the User and the item(s) left behind after the retention period specified by the previous paragraph are not retrieved, the hotel shall dispose of the relevant item(s) as found articles in accordance with the Lost Property Act.
  3. In the case that disposal of the item(s) left behind and retained by the hotel generates a profit, the hotel shall be compensated for the cost of storing the item(s) with said profit. In the case that the relevant profit exceeds the cost of storage, the hotel shall not be liable for refunding said excess profit. In the case that the hotel bears other expenses after compensating for the cost of storage, the User shall be liable for compensating the hotel for said cost. The User shall not object to the disposal of item(s) left behind by the hotel.
  4. In the case that the User or his/her agent returns to retrieve the relevant item(s), the hotel shall ask the relevant User or agent to present identification and provide his/her name, address, and telephone number in accordance with Article 3-2. The hotel may make a copy of the ID. Only when the hotel has reasonably determined that the item(s) left behind belongs to the relevant User may the relevant User or the agent take possession of the item(s). The hotel shall respond to the agent only after the User has made direct contact with the hotel about the agent. If it is found that the item(s) left behind does/do not belong to the User after the relevant item(s) has/have been handed over to the User or the agent in accordance with the provisions in this paragraph, the hotel shall not be liable therefor.

Article 5 (User’s Liability for Compensation for Damage)

In the case that the User causes damage to the hotel or a third person in regard to the use of the self-service locker, the User shall compensate for the damage.

Article 6 (Disclaimers and Liability for Damage)

  1. Self-service lockers shall be used for the purpose of temporary storage by the User on his/her own responsibility; provided, however, that said use shall not be interpreted as the hotel assuming responsibility for the Stored Item(s) in the self-service locker.
  2. For any case falling into any of the following categories, the hotel shall not be liable to compensate for the loss, damage or alteration of the Stored Item(s) (hereinafter referred to as the “Loss, etc.”) regardless of the presence or absence of negligence by the User:

(1) When the Stored Item(s) is/are prohibited from being stored by the provisions of Article 2-1 (1)-(9);
(2) When the Loss, etc. is due to the User’s incorrect locking operation or failure to lock;
(3) When the Loss, etc. is due to natural disasters or other acts of God;
(4) When the Stored Item(s) is/are investigated/inspected, seized, or required to be surrendered by authorized public agencies;
(5) When the Loss, etc. is due to destruction of the self-service locker by a third person;
(6) When the self-service locker is used in a manner that violates this Agreement; and
(7) When the Loss, etc. is not attributable to the hotel.

  1. In the case that the Loss, etc. is attributable to the hotel, the hotel shall compensate the User up to the amount equivalent to the market value of the Stored Item(s) (only if the relevant User can reasonably prove said market value), or 30,000 yen, whichever is lower.

Article 7 (Prohibited Matters)

The use of the self-service locker by a person other than a guest of the hotel (hereinafter referred to as the “Unauthorized User”) shall be strictly prohibited. If the hotel discovers the use of the self-service locker by an Unauthorized User, said Unauthorized User shall pay the fee for storage of the item(s), calculated by multiplying the number of days the item(s) is/are stored at the rate of 1,000 yen per day.

Article 8 (Jurisdiction)

Tokyo District Court shall have exclusive jurisdiction over any and all disputes arising out of or in connection with this Agreement.

Article 9 (Revision of the Agreement)

  1. The provisions of this Agreement may be revised at the discretion of the hotel.
  2. In the case that the hotel has revised this Agreement, the hotel shall post notification of the revision, the revised content of the Agreement, and the effective date of the revised Agreement at the self-service locker area two days prior to the effective date.
  3. If the User uses the self-service locker after the effective date of the revised Agreement, the User shall be deemed to have consented to the revised Agreement.
